The Firm also prepares and enforces commercial real estate brokers' liens against commercial real estate when the brokers have not received the agreed upon compensation.
Landlord/Tenant Law and Litigation (Residential Leases)
The Firm provides advice under the Alabama Uniform Residential Landlord & Tenant Act (the "Act"), and, where necessary to achieve a client's objectives, files and defends lawsuits relating to unpaid rent, breach and default, lease termination, eviction (unlawful detainer), security deposits, abandonment, maintenance and habitability, diminution in services, tenant damage, fire and casualty damage, and access to the premises. Rental premises are a source of critical revenue for the landlord and a home for the tenants. As a result, issues arising under residential leases are often contentious and tend to ignite quickly, making it more difficult and expensive to resolve a dispute. It is, therefore, highly recommended that a lawyer be consulted before a simmering legal issue becomes a serious problem. Doing so generally saves a lot of time and money and leads to a better and more cost-effective solution.
Landlord/Tenant Law and Litigation (Commercial Leases)
Depending on the type issue involved, commercial lease disputes may delay or terminate rent payments to the landlord or interfere with sales or services by the tenant. As a result, revenues for both the landlord and tenant may be diminished or suspended completely during the pendency of a commercial lease dispute. Since time is frequently a critical factor in commercial landlord/tenant disputes, the Firm works hard to resolve them in a prompt and timely manner without having to resort to litigation. This is particularly true when there is an ongoing commercial landlord/tenant relationship under a long term commercial lease that neither party wants to terminate. Therefore, subject to the client's instructions, the Firm's initial objective in resolving commercial lease disputes is to preserve the commercial landlord/tenant relationship with minimal revenue losses.
If the commercial lease dispute cannot be promptly resolved, or when it is apparent from the beginning of the Firm's involvement that the dispute will not be resolved without filing a lawsuit, then, subject to the client's instructions, the Firm will recommend a lawsuit and aggressively pursue a litigation strategy designed to achieve the client's objectives in as cost-effective a manner as possible. The Firm believes that litigation should generally be the last resort; but, depending on the nature of the commercial landlord/tenant dispute and the length of time it has existed, it is often the only remaining option.
