Employment and Employee Benefits Law

My employment law practice stresses the importance of preventive analysis, proper documentation of employer decisions, and common-sense advice to both employers and employees. I can help business clients minimize employment law disputes by developing forms, policies and procedures which comply with applicable law and by educating management and non-management employees about their responsibilities. I can also effectively defend your business if an administrative complaint (e.g., EEOC, OSHA and NLRB) or lawsuit has been filed against you by an employee. For an employee who has a meritorious claim against an employer, I can file an administrative complaint or lawsuit when necessary to protect the employee's rights under federal law.

Labor and Employment-Related Law & Litigation

I provide advice and handle litigation involving many types of employment matters, including the following:

  • Discrimination and harassment based on age, disability, gender, national origin, pregnancy, and race

  • Family and Medical Leave Act (FMLA)

  • Hiring, firing, and discipline, including proper methods of documenting employer actions

  • Job loss and re-employment issues

  • Non-compete agreements

  • Overtime and the applicability of exemptions under the Fair Labor Standards Act (FLSA)

  • Preventive analysis, long-term risk management counseling, and preparation and review of employee handbooks, and employment-related policies, procedures, and forms

  • Reductions-in-force (down-sizing), including methods of properly documenting employer actions

  • Retaliation and retaliatory discharge
  • Substance abuse policies and testing procedures

  • Unpaid sales commissions

  • Workplace safety, surveillance, and violence

Employee Benefits (ERISA) Law & Litigation

I provide advice and handle litigation relating to benefits provided by an employer to an employee, including the following:

  • Health insurance coverage, including COBRA

  • Life insurance benefits, including beneficiary designation issues

  • Long term disability insurance benefits

  • Pension and retirement benefits

  • Severance pay and other benefits arising from job loss

Although the largest percentage of my clients are located in Jefferson County (including Birmingham, Bessemer, Homewood, Hoover, Hueytown, McCalla, Mt. Brook and Vestavia Hills) and Shelby County (including Chelsea, Columbiana, Helena, Pelham and Riverchase), Alabama, a considerable number reside in or have principal offices located in States across the country, including California, Florida, Georgia, Michigan, Mississippi, New York, North Carolina, Ohio, Pennsylvania, South Carolina, Tennessee, Texas and Virginia. Another significant portion of my practice is derived from lawyer referrals, including serving as local counsel in Alabama for out-of-state litigants and handling matters in Alabama for in-house counsel.
